MANILA, Philippines — The Supreme Court (SC) has given Chief Justice Maria Lourdes Sereno 10 days to answer the petition filed by the solicitor general.
However, this does not mean that the court is already deciding the merits of the case.
“The court, without giving due course to the petition, required respondent Chief Justice Sereno to submit her comment on the petition (for quo warranto) within a period of 10 days from receipt of notice,” SC spokesperson Atty. Theodore Te said.
Associate Justice Marvic Leonen dissented, saying the petition should be dismissed instantly.
Yesterday, Solicitor General Jose Calida led the filing of the petition seeking to unseat Sereno, since her appointment is allegedly void from the beginning.
Her integrity to qualify as a chief justice is being questioned because of her alleged failure to file her Statement of Assets, Liabilities and Net Worth (SALN).
In a statement, Sereno’s spokesperson Atty. Josa Deinla said the petition should have been dismissed outright since, under the Constitution, a sitting chief justice can only be removed by impeachment.
Meanwhile, the Supreme Court dismissed the petition filed by Atty. Oliver Lozano asking the justices to remove Sereno from office.
