MUNTINLUPA CITY, Philippines — Muntinlupa City Congressman-elect Ruffy Biazon has filed a motion at the Sandiganbayan seeking dismissal of the case filed against him by the Office of the Ombudsman.
Biazon is facing graft, direct bribery and malversation due to his alleged endorsement of 3 million-peso Priority Development Assistance Fund or PDAF for projects in the lone district of Muntinlupa in 2007.
Janet Lim Napoles who was the purported middleman of the PDAF transactions was also accused.
Biazon said, he only endorsed his PDAF to implementing agencies that selected the NGOs for the projects.
He also claimed that there was no strong evidence to back up claim that he received kickbacks or commissions from the transactions.
Biazon also added that the graft charge lack merit because there was no basis for conspiracy between him, Napoles and other private individuals.
In lieu of this, Biazon is asking the court to hold the issuance of warrant of arrest and hold departure order until the court resolves his motion for judicial determination of probable cause.
