Homeowners Association need not worry because the Metropolitan Manila Development Authority (MMDA) assures they will set limitations on the use of private roads in all subdivisions.
MMDA said, the government understands the concerns of the residents of posh subdivisions and vowed to address them.
That is why MMDA also is proposing to create a law ensuring the security of residents in subdivisions that will be opened as alternate routes.
The MMDA is aware that homeowners are not easily persuaded to allow the use of their roads.
In a previous case between MMDA and Bel-Air subdivision in Makati, it can be recalled that MMDA wanted to open a part of Bel-Air road to the public. The case reached the court and MMDA lost against Bel-Air.
“The court ruled that the MMDA has no power to open private subdivisions and because of that the Supreme Court declared that MMDA has no ordinance power to do this,” said MMDA chairman Atty. Emerson Carlos.
MMDA explained that, allowing private motorists to use subdivision roads as alternative routes especially during rush hours will be beneficial to many.
“There are subdivisions that motorists can use and be open to public. This can decongest highways like EDSA. Opening of private roads can help,” Carlos said.
The MMDA plans in the near future to call on homeowners associations to tackle the said plan. — Mon Jocson / UNTV News & Rescue
