Korte Suprema, naglabas ng TRO vs. COMELEC-Smartmatic deal

MANILA, Philippines – Sa botong 12-2, naglabas ang Supreme Court en banc ng temporary restraining order o TRO sa implementasyon ng extended warranty contract ng Commission on Elections at technology provider Smartmatic TIM.

Kaugnay ito ng P240-million contract sa repair at refurbishment ng 82-libong precinct count optical scan o PCOS machines na gagamitin sa 2016 elections.

Pinagbigyan ng Korte Suprema ang mga petisyong inihain ng Integrated Bar of the Philippines (IBP) at ni Bishop Broderick Pabillo.

“The CJ, joined by Justice Velasco, dissented because they were of the view that the issue should first be heard on oral argument,” pahayag ni Supreme Court Public Information Chief Atty. Theodore Te.

Sa dalawampu’t walong pahinang petisyong inihain ng IBP noong Pebrero, sinabi nitong bigong ma-satisfy ng COMELEC-Smartmatic contract ang mga kondisyon sa direct contracting sa ilalim ng Government Procurement Reform Act.

Samantala, dinismiss ng Korte Suprema ang petition for certiorari and prohibition na inihain ng Citizens for Clean and Credible Elections (C3E), at nina Homobono Daza at Jonathan Sinel laban sa COMELEC at Smartmatic TIM.

Hindi kinatigan ng kataas-taasang hukuman ang hiling ng mga petitioner na ipatigil ang pagdaraos ng COMELEC ng public bidding para sa supply, lease at purchase ng Optical Mark Readers (OMR) at direct recording electronic machines.

Hindi rin inayunan ng korte ang petisyon na pigilan ang Smartmatic na lumahok sa bidding.

Ayon kay Te, premature ang nasabing mga petition.

“The court noted that the COMELEC is a consti body tasked with the specialized mandate… thus, should have been given the oppo to pass upon this matter,” saad nito. (Bianca Dava / UNTV News)
